Q : My boyfriends mom gave us her house. she no longer wants anything to do with it. we are in the process of changing the title over into my partner’s name. we have moved in and taken over the house payments. the property is seller financed and the loan is still in my boyfriends mom and dads name. his mom and dad have divorced and his dad is now remarried . his dad signed over an interspousal transfer deed 7years ago. his dad and new wife are claiming that they will get 1/3 of the money if and when the property ever sells. my question is- because my boyfriends mother is giving us the property and not selling it to us, will that take his dad and crazy new wife out of the picture? remember also that the seller financing agreement is still in both my partner’s mom and dad name. and now that dad is remarried, what can happen, and what should we do????
